MCKEE PRESTIGE TRANSPORTATIONTEXAS PASSENGER LIABILITY WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND PROPERTY DAMAGE AGREEMENTPLEASE READ CAREFULLY. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS.In consideration for being permitted to utilize transportation services provided by McKee Prestige Transportation (“Company”), the undersigned passenger agrees as follows:ASSUMPTION OF RISKI understand and acknowledge that transportation services involve risks, including but not limited to motor vehicle accidents, sudden stops, road hazards, weather conditions, acts of third parties, entering and exiting vehicles, and other unforeseen events. I voluntarily assume all risks associated with my participation in and use of the Company’s transportation services.RELEASE OF LIABILITYTO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, I HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE MCKEE PRESTIGE TRANSPORTATION OR MCKEE CONSULTING LLC, ITS OWNERS, OFFICERS, EMPLOYEES, DRIVERS, CONTRACTORS, AGENTS, SUCCESSORS, AND ASSIGNS FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, ACTIONS, CAUSES OF ACTION, COSTS, EXPENSES, OR LIABILITIES FOR PERSONAL INJURY, PROPERTY DAMAGE, ILLNESS, DEATH, OR OTHER LOSSES ARISING OUT OF OR RELATED TO THE USE OF THE COMPANY’S SERVICES, EXCEPT TO THE EXTENT SUCH LIABILITY CANNOT BE WAIVED UNDER APPLICABLE TEXAS LAW.PASSENGER RESPONSIBILITIESPassengers agree to:• Wear seat belts when available and required by law.• Follow all instructions provided by the driver.• Enter and exit the vehicle safely.• Refrain from distracting the driver.• Comply with all applicable federal, state, and local laws.PROPERTY DAMAGE LIABILITYThe individual signing this Agreement shall be financially responsible for any damage caused by themselves or any member of their party.Damages include but are not limited to:• Tears, burns, stains, or damage to upholstery• Broken glass, windows, mirrors, or accessories• Interior or exterior scratches, dents, or vandalism• Damage resulting from food, beverages, smoking, or vaping• Damage caused by pets, children, or guests• Excessive cleaning requirementsPassenger agrees to pay all repair, replacement, cleaning, administrative, legal, towing, loss-of-use, and related expenses incurred by the Company.CLEANING FEESAny passenger who causes excessive cleaning needs, including but not limited to spills, bodily fluids, vomiting, smoke odors, or other contamination, agrees to pay all associated cleaning and sanitization costs.PERSONAL PROPERTYMcKee Prestige Transportation is not responsible for lost, stolen, forgotten, or damaged personal property. Passengers are solely responsible for their belongings.PROHIBITED CONDUCTThe following are prohibited:• Smoking or vaping in any Company vehicle• Illegal drug use or possession• Possession of illegal weapons• Violent, threatening, abusive, or disruptive behavior• Intentional damage to Company property• Interference with vehicle operationThe Company reserves the right to immediately terminate services without refund if prohibited conduct occurs.ALCOHOLPassengers are solely responsible for complying with all applicable Texas alcohol laws. No underage drinking shall be permitted. McKee Prestige Transportation reserves the right to refuse transportation to any passenger whose conduct creates a safety risk.DELAYS AND FORCE MAJEUREThe Company shall not be liable for delays caused by traffic, weather, road closures, accidents, mechanical issues, government actions, public emergencies, or other events beyond its reasonable control.INDEMNIFICATIONPassenger agrees to defend, indemnify, and hold harmless McKee Prestige Transportation from any claims, damages, liabilities, costs, attorney’s fees, or expenses arising from Passenger’s conduct, negligence, violation of law, or breach of this Agreement.GOVERNING LAW AND VENUEThis Agreement shall be governed by the laws of the State of Texas. Any dispute arising under this Agreement shall be brought exclusively in a court of competent jurisdiction located in Bexar County, Texas.SEVERABILITYIf any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.ACKNOWLEDGMENTI acknowledge that I have carefully read this Agreement, understand its contents, and voluntarily agree to be bound by its terms.
